Changes that alter the content of a Paid Plan to your disadvantage will not apply until the end of the subscription period current at that time.

  5. If the Company stops providing the entire Service, it will give notice at least 60 days before the end date and provide an opportunity to export images and other data you have saved. The handling of any remaining subscription period is governed by Article 9.

  6. The Company's liability for any change or discontinuation under the preceding paragraphs is governed by Article 16.

Article 4 (Account Creation)

  • You can create an account with a passkey or an external ID.
  • Registration may be refused in cases of false registration or a history of violating these Terms. Anyone under 18 may not use the Service, and those who are minors under the laws of their place of residence need parental consent.
  1. By creating an Account with a passkey or through an External ID Provider approved by the Company, you may use all or some of the features of the Service.

  2. The Company may refuse the creation of an Account if your authentication information contains false information, or if you have previously been subject to measures such as suspension of use due to a violation of these Terms.

  3. Anyone under the age of 18 may not use the Service.

  4. Even if you are 18 or older, if you are a minor under the laws of the country or region where you live, you shall use the Service only after obtaining the consent of your legal guardian.

Article 6 (License)

重點

  • You may use the Service within the scope of personal and internal purposes.
  • Reuse such as copying, modifying, or reverse engineering is prohibited.
  1. Subject to your compliance with these Terms, the Company grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited right to use the Service for personal and internal purposes.

  2. Except as expressly permitted by the Company, you must not copy, modify, adapt, decompile, reverse engineer, create derivative works of, resell, or engage in any similar act with respect to the Service or its software, screens, data structures, or related technologies.

Article 7 (User Content)

重點

  • User content is limited to content you can lawfully handle, and rights in it generally remain with you.
  • Try-on model photos must be of yourself or of a person aged 18 or older who has consented; photos of anyone under 18 cannot be used.
  • It is stored and displayed to provide the Service, and sent to external AI services for the AI features.
  1. You warrant that you have the right to lawfully register and use your User Content, and that it does not infringe any copyright, trademark right, portrait right, privacy right, or other right of any third party.

  2. Model photos used for try-on must be photos of yourself, or photos of a person aged 18 or older who has given consent. Photos in which a person under 18 appears cannot be used as model photos, even with the consent of a parent or guardian.

  3. If a third party appears in a photo of an item or outfit, register the photo only after obtaining that person's consent. The Service may send photos to external AI services for analysis (paragraph 5).

  4. Rights in User Content are reserved to you or to the legitimate rights holder.

  5. The Company stores, reproduces, and displays User Content to the extent necessary to provide the Service. In addition, to the extent necessary to provide the AI Features, the Company may send User Content to external AI service providers and use it for analysis, generation, and suggestions. Such transmission is not limited to the time you register User Content; it may also take place afterward, without any action on your part each time, for purposes such as suggesting outfits and creating item images. The information to be sent is set out in the Privacy Policy.

  6. The Company does not use your User Content for the purpose of training its own AI models.

  7. When sending data to external AI service providers, the Company does not engage in log sharing, dataset sharing, or feedback sharing unless the Company expressly indicates otherwise.

  8. The Company will not use User Content for advertising or promotional purposes, except where the Company has separately and expressly obtained your consent or in cases based on laws and regulations.

  9. If the Company receives a report from a third party alleging that User Content infringes copyright, trademark rights, portrait rights, privacy rights, or other rights, the Company may conduct any necessary investigation and, to the extent it reasonably deems necessary, make such User Content private, delete it, suspend the Account, or take other measures. Reports are accepted at the contact point in Article 26.

  10. If the Company reasonably determines that there has been a serious or repeated infringement of rights, the Company may take legal measures such as reporting to the relevant authorities, requesting disclosure of sender information, and claiming damages.

Article 8 (AI Features)

重點

  • Try-on images are reference images newly created by AI and may differ from the actual item or from you.
  • Check product information or the actual item before important decisions. Rights in AI output belong to you to the extent permitted by law.
  • Removing the labels or marks on AI-generated images, or presenting them as real photos or as images from a brand, is prohibited.
  1. The Service uses generative AI to create images (including try-on images based on your photos; "Try-On Images") and text.

  2. Try-On Images are images newly created by AI as a reference for how clothes might look when worn; they are not your photos edited as they are. The fit, feel, color, texture, silhouette, depiction of body shape, resemblance to you, and other aspects of Try-On Images may differ from reality. In addition, due to the nature of AI, facial features, hair, skin tone, body shape, background, and the like may change unintentionally, and parts of objects or people in the original photo may remain.

  3. Do not make important decisions, such as purchasing a product, based only on Try-On Images or AI suggestions; check the product information or the actual item.

  4. The Company takes reasonable care so that the AI Features work as described, but cannot promise that AI output will always be accurate and complete. However, this paragraph does not limit your statutory rights set forth in Article 15, paragraph 3.

  5. As between you and the Company, rights in Try-On Images and other AI output belong to you to the extent permitted by law. The Company uses the output only to provide and maintain the Service (the Company does not use it to train its AI, as set forth in Article 7, paragraph 6). Due to the nature of AI, similar output may also be created for other users.

  6. Where required by law or otherwise necessary, the Company adds to images created with AI a visible label indicating that they were created with AI and a mark in the data (such as metadata or a digital watermark).

  7. You must not do any of the following:
    (1) Remove, alter, or make unreadable the labels or marks described in the preceding paragraph
    (2) Present an image created with AI as if it were an actual photograph
    (3) Present a Try-On Image as if it were an image created by, or approved by, a brand, manufacturer, or seller

Article 9 (Fees and Paid Plans)

重點

  • Paid plans are purchased, renewed, and canceled through the App Store.
  • The AI features have daily and monthly usage limits, and the number of uses allowed may change.
  • Refunds are handled by Apple, and consumers in the EU and the UK can withdraw within 14 days. The rights you have under the laws of your country or region are not limited.
  1. The Service offers a free plan and Paid Plans, and the available features, storage limits, and other conditions are as displayed by the Company on the Service. The AI Features are subject to daily and monthly usage limits ("Usage Limits"). The number of uses under the Usage Limits is set by the Company taking into account factors such as the cost and availability of external AI services and the prevention of unauthorized use; it is not a promise of any particular number of uses, and it may change in accordance with Article 3, paragraphs 3 and 4.

  2. Purchases of and payments for Paid Plans of the Service are made only through the App Store.

  3. The timing of charges at the initial purchase and at each renewal is governed by the App Store's rules.

  4. Paid Plans are auto-renewable subscriptions offered through the App Store. They renew automatically unless you cancel them on the subscription management screen of your Apple Account.

  5. In accordance with Apple's rules, renewal fees are charged within 24 hours before the start of the next subscription period. If the price changes, Apple will notify you in advance and, where required, ask for your consent.

  6. Subscriptions shall be canceled from the subscription management screen in the App Store. Deleting the app alone does not automatically cancel your subscription. Even after cancellation, you can continue to use the Paid Plan until the end of the contract period.

  7. Refunds for Paid Plans are decided and made by Apple through the procedures Apple specifies (such as Apple's "Report a Problem"). The Company cannot directly refund the price of Paid Plans purchased on the App Store. If Apple requests it, the Company will cooperate by providing the information needed for Apple's refund decision.

  8. Consumers who live in the EU (European Economic Area) or the UK may, in accordance with Apple's Media Services Terms and Conditions, withdraw from the purchase of a Paid Plan without giving any reason and receive a refund within 14 days of the first purchase (for example, through the purchase history of their Apple Account). The conditions under which the right of withdrawal is lost are governed by Apple's Media Services Terms and Conditions.

  9. If the Company stops providing the entire Service under Article 3, paragraph 5, or ends the contract under Article 14, paragraph 7, it will explain how to request a refund from Apple for the remainder of the subscription period. If Apple does not grant a refund, the Company will refund an amount corresponding to the remaining period.

  10. This Article does not limit any right to withdraw an order, obtain a refund, or any other right that you have under the laws of the country or region where you live.

  10. Creating, registering, or sending content that sexually depicts a person under 18

  11. Creating or attempting to create nude, underwear, or other sexual images, and registering, creating, or sending sexual images without the consent of the person depicted

  12. Impersonating a real person, or creating or spreading images that make a real person appear in a state or doing something they did not actually do (so-called deepfakes)

  16. Acts of posting, sending, or saving the personal information, confidential information, or trade secrets of third parties without authorization

  1. All copyrights, trademark rights, know-how, software, designs, databases, screen displays, and other intellectual property rights relating to the Service belong to the Company or to third parties that license them to the Company.

  2. The license to use the Service under these Terms does not constitute a transfer of, or a comprehensive license to, the intellectual property rights relating to the Service.

重點

  • Your information is handled in accordance with the Privacy Policy.
  • The Company may collect the minimum necessary logs for maintenance, responding to system failures, and security measures.

Article 14 (Suspension of Use, Deletion, and Withdrawal)

重點

  • You can withdraw at any time from the app's settings. Withdrawal does not stop automatic renewal, so cancel on Apple's screen.
  • Suspensions are made only for specified reasons; in principle, you are notified in advance and told the reasons and how to object when measures are taken.
  • If the contract is ended for reasons other than your violation, you will be notified 30 days in advance and given an opportunity to export your data.
  1. You may withdraw (delete your Account) at any time from the app's settings. Withdrawal does not stop the automatic renewal of a Paid Plan, so cancel it on Apple's subscription management screen.

  2. After withdrawal, your Account, User Content, and other principal data directly linked to your Account will, in principle, be deleted, except where retention is required by laws and regulations or where there is a legitimate reason such as preventing unauthorized use, ensuring security, responding to system failures, handling payments, or responding to audits.

  3. In any of the following cases, the Company may, to the extent necessary, suspend your use of all or part of the Service, stop publishing or delete User Content, or suspend or delete your Account (collectively, "Suspension"):
    (1) When an act falling under the prohibited conduct in Article 10 or another serious breach of these Terms has occurred
    (2) When you have not remedied a breach of these Terms within 14 days after the Company requested you to do so
    (3) When you have repeatedly breached these Terms
    (4) When required by laws and regulations or by an order of a court or administrative agency
    (5) When immediate action is necessary to protect the life, body, or property of others or the safety of the Service

  4. Before a Suspension, the Company will notify you of the reasons and give you an opportunity to remedy the matter or state your opinion. However, in the cases in items (4) or (5) of the preceding paragraph, or where advance notice could harm an investigation or the safety of others, the Company will notify you promptly after the Suspension.

  5. When the Company makes a Suspension, it will notify you of the following matters, at the latest at that time, by in-app notice (and also by email if a registered email address exists):

    (2) The reasons for the measure (the applicable provisions of these Terms or laws and regulations, and the facts on which the decision was based)
    (3) Whether automated means were used in making the decision
    (4) How to file an objection

  6. If you object to a Suspension, you may file an objection with the contact point in Article 26 within 6 months from the date you received the notice. The Company will review the objection, inform you of the result and the reasons, and promptly reverse the measure if it was made in error.

  7. If the Company ends the contract for the Service for reasons other than your breach of these Terms, it will give notice at least 30 days in advance and provide an opportunity to export images and other data you have saved. The handling of the remaining subscription period is governed by Article 9.

  8. Notwithstanding paragraph 2, operation logs, security logs, analytics logs that have been anonymized or processed into a form that does not directly identify individuals, and other similar records may be retained for the period necessary for the purposes described in paragraph 2. The retention period for each type of information is set out in Section 12 of the Privacy Policy. It may take a reasonable period of time to complete the deletion of image files and certain other data. After your Account is suspended or deleted, you may be unable to access all or part of the data saved in the Service.

Article 15 (Warranties)

  1. The Company provides the Service with the care and skill ordinarily expected of a business.

  3. The preceding paragraph does not limit the rights that the laws of your country or region give consumers (including the statutory rights that consumers in the EU, the UK, Switzerland, and elsewhere have when digital content or digital services do not conform to the contract).

  4. The Company takes reasonable measures to avoid losing User Content. Please also save important images on your device, for example with the image saving feature.

The same applies where liability cannot be limited under laws and regulations.

  3. Except in the cases in the preceding paragraph, for damage caused by the Company's slight negligence (meaning negligence other than gross negligence), the Company will compensate only damage that would ordinarily arise (damage within the scope foreseeable at the time of the contract), up to the higher of the amount you paid for Paid Plans during the 12 months immediately preceding the event that caused the damage or 10,000 yen.

  4. Special terms for consumers in the EU, the UK, and Switzerland are set out in Article 27.

Article 17 (Indemnification)

重點

If the Company or its affiliates incur any claim, damage, loss, cost, or other burden (including attorneys' fees within a reasonable range) arising from a breach of these Terms due to reasons attributable to you, User Content that includes an infringement of third-party rights, or illegal or inappropriate use of the Service, you shall indemnify the Company or its affiliates for the same.

If the provision of all or part of the Service is delayed or becomes impossible due to natural disasters, fire, power outages, telecommunications line failures, war, civil unrest, terrorism, infectious diseases, acts of governments or administrative agencies, amendments to laws and regulations, failures of external services, or any other cause beyond the Company's reasonable control, the Company shall not be liable therefor, except in the case of willful misconduct or gross negligence on the part of the Company.

  • You can bring a claim in the court of your place of residence, and the Company will bring any claim against you in the court of your place of residence.
  • The Japanese version is the original. For consumers in the EU (European Economic Area), the UK, Switzerland, and Quebec, the version in your language is also an original, and the version more favorable to you applies if there is a discrepancy.
  1. These Terms are governed by the laws of Japan. However, for consumers in the countries and regions set forth in Article 27, the provisions of that Article apply.

1. Selling Price

The Service plans to offer a paid plan in the form of an auto-renewable subscription. The standard prices currently planned are ¥1,000 per month (tax included) or ¥9,800 per year (tax included) for rackin Pro.

When a promotion applies, a free trial period or other conditions may be attached. For the actual applicable conditions, the first billing date, and the amount billed at each renewal, the information shown on the App Store purchase confirmation screen as the total amount including consumption tax takes precedence.

If you would like to receive details of the selling price, the total amount payable, or other matters required to be disclosed by law individually in writing or by email, please send a request to the contact above, and they will be provided without delay.

2. Charges Other Than the Price

Communication charges and other costs for connecting to the internet are your responsibility.

3. Payment Method

The payment method planned after launch is App Store payment in the iOS app.

4. Payment Timing

After launch, you will be charged at the time of your initial purchase. Renewal fees are charged within 24 hours before the start of the next subscription period, in accordance with Apple's rules.

5. Timing of Service Provision

After launch, you can use the Service immediately once payment is completed.

6. Subscriptions and Automatic Renewal

After launch, the paid plan of the Service is planned to be an auto-renewing subscription.

It renews automatically unless you cancel it on the subscription management screen of your Apple Account. Standard plans renew on a monthly or annual basis; for free trial periods or other conditions that apply under a promotion, the information shown on the purchase confirmation screen takes precedence.

If the price changes, Apple will notify you in advance and, where required, ask for your consent.

7. How to Cancel

After launch, please cancel your subscription from the subscription management screen in the App Store.

You can cancel using either of the following methods.

  • "Settings" on your iPhone > your name > "Subscriptions"

  • "App Store" > profile icon at the top right > "Subscriptions"

  • In this app, the "Settings" tab > "rackin Pro" (opens the App Store subscription management screen)

Even after cancellation, you can continue to use the Service until the end of the contract period.

Because the subscription for the Service is expected to use the App Store's subscription billing feature after launch, cancellation is completed on the App Store's subscription management screen.

For details on managing and canceling subscriptions, please see Apple's official support page below.

8. Returns and Refunds

Due to the nature of digital content, the Company, as a general rule, does not provide refunds.

However, refunds may be granted under the App Store's rules. If you wish to receive a refund, please submit a request to Apple; whether a refund is granted is subject to the conditions set by Apple.

For details on the refund process in the App Store, please see Apple's official support page below.
https://support.apple.com/ja-jp/HT204084

9. Cooling-Off

Because the Service falls under mail order sales, the cooling-off system does not apply.

10. System Requirements

The Service is recommended for use on the supported OS and device environments that the Company specifies on each distribution channel. Before purchasing a paid plan, please be sure to confirm that the Service works properly on your device and OS version. After launch, paid plans are planned to be available for purchase only in the iOS app.

11. Notes on Representations and the Service

Suggestions made by AI in the Service are reference information only, and their effects or results are not guaranteed.
